Terms of Service

1. Scope

These Terms of Service govern all contracts between Luca Marino, 88074 Meckenbeuren, Germany ("Provider") and users of the VoiceGen platform ("Service"). Conflicting terms are not accepted unless the Provider expressly agrees to them in writing.

2. Service

The Provider offers a SaaS platform that lets users generate images, videos, audio and text via third-party AI models (notably fal.ai and Cloudflare Workers AI). Specific features available at any time may change without notice.

3. Account & pricing

Full use requires an account. Anonymous users receive a limited number of free generations. Paid plans are billed through Stripe; prices and limits are listed on the pricing page.

Subscriptions run monthly and renew automatically until cancelled before the next billing period. Cancel via the Stripe customer portal or by email to support@voice-ai-generator.com.

4. Withdrawal right for on-demand digital content

For on-demand digital content (e.g. a single AI generation), the 14-day right of withdrawal under EU consumer protection law ceases once we begin performance and the user has expressly consented and acknowledged this. Initiating a paid generation constitutes such consent.

5. Licence to generated content

Subject to the underlying model licence (e.g. Flux, Kling, Hailuo, Veo) and applicable law, the Provider grants users a worldwide, non-exclusive, transferable right to use the content they generate. Free-plan generations carry additional restrictions per the pricing page (no commercial use, watermark required).

Users are responsible for ensuring their prompts and reference images do not infringe third-party rights (copyright, trademarks, personality rights).

6. Prohibited use

You may not use the Service to generate, in particular: depictions of sexual violence or abuse, especially involving minors; non-consensual intimate imagery of real people; deepfakes intended to deceive or defame; targeted harassment or defamation; content aimed at unlawful discrimination; or content that circumvents the licence and content policies of the underlying model providers.

On violation the Provider may suspend the account without notice and make any legally required reports.

7. Availability

The Provider aims for high availability but does not warrant any specific uptime. Scheduled maintenance and model-provider outages may temporarily restrict the Service.

8. Liability

The Provider's liability for damages to life, body or health, for fraudulently concealed defects, and under product-liability law is unlimited. Otherwise liability is limited to gross negligence and intent; for ordinary negligence only where a cardinal obligation has been breached, and limited to the contract-typical, foreseeable damage.

The Provider does not warrant the accuracy, completeness or fitness for purpose of content produced by the underlying model providers.

9. Data protection

Information on processing of personal data is set out in the Privacy Policy.

10. Miscellaneous

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Sales Convention. If you are a consumer per § 13 BGB, this choice of law applies only insofar as it does not deprive you of mandatory protection under the law of your country of habitual residence.

If individual provisions are invalid, the remaining provisions remain in force.
